Reminder: Colorado's EPR Registration Deadline Approaching—Is Your Organization Compliant?

SEMA wants to remind you about the upcoming producer requirement under Colorado’s Extended Producer Responsibility (EPR) program. If your organization sells, distributes, or imports packaging or paper products into Colorado, you may be required to register with the Circular Action Alliance (CAA) by October 1, 2024, unless you plan to submit an individual program plan.

Is My Organization Required to Participate in Colorado’s EPR Program?
To determine if you must register, your organization must:

  1. Have at least $5,506,200 million in annual total revenue or use one ton or more of packaging materials in Colorado annually.
  2. Ensure that your products are not exempt from “covered materials” as defined by Colorado law.

Does My Organization Qualify as a “Producer”?
Your organization is considered a “producer” if any of the following apply:

  • You manufacture packaging or paper products under your own brand or import covered materials into Colorado.
  • You sell or distribute products in Colorado through internet transactions that require packaging materials.
  • You publish or distribute paper products such as magazines, newspapers, or catalogs.

There are several exclusions, such as packaging for long-term storage, FDA-regulated products, and certain paper products, which may not require participation.
