North Dakota Bill to Restrict Vehicle Modifications Favorably Amended by Committee; Moves to Full House 

A bill (S.B. 2166) that originally sought to increase the population of vehicles prohibited from modifying the manufacturer's original suspension, steering or brake system was amended and approved by the North Dakota House Transportation Committee.  Under the amendment, the bill would no longer restrict modifications on vehicles weighing between 7,000 - 10,000 pounds.   The bill now moves to the full North Dakota House for a vote by all members. S.B. 2166 is now worthy of our support.

  • S.B. 2166 retains the current law so that the modified vehicle restrictions will continue to apply only to vehicles weighing 7,000 pounds or less.  The original bill had expanded it to cover vehicles weighing 10,000 pounds or less.
     
  • S.B. 2166 removes the crime of "operating a modified vehicle" from the list of crimes for which an officer may take the driver into custody.
     
  • S.B. 2166 changes the modified vehicle law to provide that any modifying equipment must meet the North Dakota requirements applicable to all other vehicles.
     
  • S.B. 2166 changes the modified vehicle law to provide that larger tires must be branded with a DOT identification number.  By Federal regulation, tires are already required to carry a DOT number.
     
  • S.B. 2166 deletes the current provision in the modified vehicle law specifying that "the maximum outside diameter permitted for tires is forty-four inches."
     
  • S.B. 2166 deletes the current provision in the modified vehicle law limiting maximum lift in the suspension system to four inches.
